CA rejects Rosanna Roces' plea in breach of contract case

MANILA -- The Court of Appeals (CA) has turned down the appeal of actress Rosanna Roces on its earlier decision which found her liable for breach of contract and ordered her to pay PHP3.1 million in damages to a beauty clinic.

In a two-page resolution dated January 18 written by Associate Justice Ramon Bato Jr., the CA’s former Eleventh Division denied the motion for reconsideration of its June 6, 2018 decision and said "there are no new and substantial issues raised therein which have not been judiciously passed upon by this Court".

Associate Justices Ramon Cruz and Pablito Perez concurred in the decision.

“Accordingly, the instant motion for reconsideration is denied for lack of merit,” it added in ruling against Roces, who currently appears in the ABS-CBN afternoon drama series 'Los Bastardos'.

The original CA ruling upheld the Quezon City Regional Trial Court Branch 220's decision which found merit in the breach of contract and damages complaint filed by Forever Flawless Face and Body Center against Roces, who is known as Jennifer Molina in real life.

Roces had received shares from Forever Flawless in an exchange deal for her promoting, endorsing, marketing and advertising services. The actress then proceeded to endorse the clinic’s services and products including treatments by aesthetics specialist Victoria “Vicki” Belo.

In 2003, Roces decided to sell and Forever Flawless agreed to buy her shares for PHP1.5 million. A deed of sale was later signed by both parties with the condition that Roces will not malign or discredit the company, its services, products and its stockholders and officers.

The deed of sale also stipulated that Roces would have to pay PHP1 million for each infraction of the contract.

Roces, however, appeared in various television interviews accusing Belo of conducting flawed liposuction procedure, prompting the suit. (PNA)
