CSC working on IRR of law on gov’t workers’ night shift pay

MANILA – The Civil Service Commission (CSC) is working on the Implementing Rules and Regulations (IRR) of Republic Act (RA) 11701 granting a night shift differential pay to government employees.

The law states that government employees rendering work beyond their regular schedule between 6 a.m. to 6 p.m. or those who need to put in additional work from 6 p.m. until 6 a.m. of the following day will be qualified for the pay.

The night shift differential pay is in addition to and shall not in any way diminish whatever benefits and allowances currently enjoyed by the government employees.

“Meron na ho kaming working draft na IRR na ginawa ng policy office namin. Pinapa-legal…sa office of legal affairs and after that we’ll be coordinating with the DBM [Department of Budget and Management] para sa karagdagang mga inputs (We already have a working draft of the IRR prepared by our policy office. It is with the office of legal affairs and after that we’ll be coordinating with the DBM for additional inputs), CSC commissioner Aileen Lizada said in a televised public briefing Monday.

The rules of the night shift differential will apply to government employees occupying items such as division chief and below or equivalent, including those in the government-owned and controlled corporations (GOCCs) and local government units (LGUs), Lizada said.

Contract of service and job order employees are not entitled for the pay as they are not considered government employees.

“Ang sweldo po nila ay hindi galing sa personnel services, galing po sila sa MOOE [Maintenance and Other Operating Expenses]. Hindi po iyan released ng DBM so hindi po sila kasama sa (Their salaries are not from personnel services, but from MOOE. It’s not released by DBM, so they’re not included in the) night shift differential pay,” Lizada said.

The night shift differential pay for government employees working in LGUs and GOCCs will be charged to their executive corporate funds and sources of regular income.

“Hindi po galing sa DBM ang pondo, galing po sa pondo ng (The fund is not from DBM, but from the funds of) GOCCs and LGUs under the Republic Act 7160 subject to the limitations provided by law,” Lizada said. (PNA)
