MANILA – The Land Transportation Office (LTO) and the Land Transportation Franchising Regulatory Board (LTFRB) have suspended a driver and his bus operator following a vehicular accident that resulted in the death of a traffic enforcer.

In a message to reporters on Wednesday, Department of Transportation (DOTr) Assistant Secretary Goddes Hope Libiran said the LTO has issued a show cause order (SCO) against Nolan De Villa, a driver of Joanna Jesh Transport, for his involvement in the vehicular accident along the Epifanio Delos Santos Avenue (Edsa) in Barangay Philam, Quezon City on Tuesday.

“The accident resulted in the death of an I-ACT (Inter-Agency Council for Traffic) enforcer. Pending investigation, the driver’s license of Mr. De Villa is preventively suspended for 90 days effective upon the receipt of the SCO,” Libiran said, without naming the traffic enforcer.

Libiran said a representative of the bus company received the show cause order.

The LTFRB said it has also issued a 30-day “preventive suspension order” against Joanna Jesh Transport with a hearing set on Monday.

De Villa will face investigation for reckless imprudence resulting in homicide or violation of Section 27 (improper person to operate a motor vehicle), and Section 48 (reckless driving) of Republic Act 4136 or the Land Transportation and Traffic Code.

He was ordered to submit a written comment on why his driver’s license should not be suspended or revoked before the LTO’s Law Enforcement Service – Anti-Drunk and Drugged Enforcement Unit on November 27.

“For the operator, please explain why this Office should not sanction your company for your failure to exercise extraordinary due diligence in the selection and supervision of your driver,” the SCO read. (PNA)
